The Israeli military on Monday ordered the ruling of the High Court of Justice to be enforced and the land that was the post-1967 community of Homesh until the unilateral Gaza withdrawal in 2005 be returned to its Palestinian owners. But the Palestinians insist Jewish Israeli remain there despite the order. The land was confiscated by Israel for military use in 1978, and a civilian community grew up there as well. When Israel abandoned the Gaza Strip, Homesh was one of the West Bank communities also abandoned, but the evacuation never fully materialized. The Palestinian owners filed and won the lawsuit which nullified the decree that established Homesh. The Israelis now on the site are in violation of a military order barring Israelis.
