US Federal Judge Orders Palestinian Authority and PLO to Post $10 Million Bond in Terror Case

The unusual intervening by the Obama administration in the appeal phase of case in which the Palestinian Authority and Palestine Liberation Organization (PLO) were held liable for terrorist acts committed against US citizens in the early 2000s has resulted in an order for the two entities to post a $10 million bond and an additional $1 million monthly as the appeal progresses. Had the government not told the court that the statutory bond to cover the jury verdict of $655 million “would undermine several decades of U.S. foreign policy and add a new destabilizing factor to the region,” a bond in the higher amount would have secured the interests of the plaintiffs whose attorneys argued the amount was too low. Last February, the Federal Court jury found the PA and PLO responsible for six terrorist attacks carried out by Hamas and the Fatah-linked Al-Aqsa Martyrs Brigades between 2002 and 2004 in which 33 people were killed and more than 450 were wounded. Damages were tripled by virtue of the federal terrorism statue. At trial, plaintiffs were able to show the systematic support for terrorists and their families provided by the Palestinian Authority and PLO.
