ICJ Finds Israeli Settlements in West Bank, East Jerusalem Violate International Law

The International Court of Justice (ICJ) has delivered a stern ruling against Israel, finding its settlement policies in the West Bank and East Jerusalem in violation of international law. The court highlighted that the Israeli government’s extension of domestic law to these areas, including the settlements and its regulatory powers as part of a prolonged occupation, effectively entrenches Israel’s control over the occupied Palestinian territories.

The court’s findings detailed how the maintenance and expansion of settlements, construction of the security wall, and exploitation of natural resources, along with the declaration of Jerusalem as the capital of Israel and the comprehensive application of Israeli domestic law in these regions, are designed to cement Israeli control indefinitely and create irreversible changes on the ground.

According to the ICJ, these actions by Israel amount to the annexation of large parts of the Palestinian territory, a move that contradicts the international norm against the acquisition of territory by force and the use of force in international relations.

Additionally, the court criticized Israel’s handling of violence by settlers against Palestinians, stating that Israel’s failure to prevent and punish these acts effectively contributes to a coercive environment against Palestinians. This ruling aligns with the broader conclusion that the Israeli settlements in the West Bank and East Jerusalem, along with the associated administrative and legal regime, have been established and are maintained in direct violation of international law.
